1. Definitions

In these Terms and Conditions:

• "ooceandi" / "we" / "us" refers to the company operating yacht tours under the ooceandi name, registered in Malaysia.
• "Guest" / "you" refers to any individual who submits an enquiry, books a tour, or boards a vessel operated by ooceandi.
• "Tour" refers to any of the three scheduled yacht tour experiences: Straits Morning Departure, Mersing Islands Day Sail, or Southern Waters Overnight Passage.
• "Booking" refers to a confirmed reservation for a Tour, acknowledged in writing by ooceandi.
• "Website" refers to this site at ooceandi.live and all associated pages.

2. Acceptance of Terms

By using this website or making a booking with ooceandi, you confirm that you are aged 18 or over, that you have the legal capacity to enter into this agreement, and that you accept these Terms in full. If you are making a booking on behalf of a group, you are responsible for ensuring all members of that group are aware of and comply with these Terms.

3. Tour Services

ooceandi provides yacht-based tour experiences departing from Danga Bay, Johor Bahru, Malaysia. Three tours are available:

• Straits Morning Departure — 3 hours, MYR 1,060
• Mersing Islands Day Sail — full day, MYR 3,000
• Southern Waters Overnight Passage — 2 days/1 night, MYR 4,950

All tours are subject to a maximum of eight guests. Tours operate subject to weather and maritime conditions and are available to guests aged 8 and over unless otherwise agreed. Children under 16 must be accompanied by an adult.

4. Bookings and Payment

Bookings are confirmed upon receipt of a deposit as communicated by ooceandi at the time of booking. The balance is due at least 7 days before the tour departure date. Specific payment terms, amounts, and accepted methods are communicated directly by ooceandi during the booking process. No payment is processed through this website.

All prices are quoted in Malaysian Ringgit (MYR) and include all items listed in the respective tour description on this website.

5. Cancellations and Weather

By the guest: Cancellations made more than 14 days before departure are eligible for a full refund of the deposit. Cancellations within 14 days of departure forfeit the deposit. Cancellations within 7 days of departure forfeit the full tour amount paid.

By ooceandi (weather): If ooceandi cancels a tour due to unsafe weather or maritime conditions, guests will be offered a full rescheduled option at no additional cost. If rescheduling is not possible, a full refund of amounts paid will be issued. ooceandi is not liable for travel, accommodation, or other costs incurred by guests in connection with a weather cancellation.

6. Health, Safety, and Guest Responsibilities

Guests are expected to follow all safety instructions from the captain and crew at all times. Guests must disclose any relevant medical conditions, reduced mobility, or inability to swim when booking. ooceandi reserves the right to refuse boarding if a guest's condition presents a safety risk to themselves or others.

Guests are responsible for their personal belongings on board. ooceandi is not responsible for loss or damage to personal property.

7. Intellectual Property

All content on this website — text, images, and design — is the property of ooceandi or licensed to us. You may not reproduce, republish, or distribute any content from this website without written permission from ooceandi.

8. Disclaimers

Tours are provided on an "as operated" basis. While we make every effort to deliver the experience as described, specific sightings, wildlife encounters, or site conditions cannot be guaranteed. Route adjustments may be made at the captain's discretion for safety or operational reasons. We do not guarantee specific views, wildlife sightings, or sea conditions.

9. Limitation of Liability

To the fullest extent permitted by Malaysian law, ooceandi's liability to you for any claim arising from a Tour booking shall not exceed the total amount paid by you for that Tour. We are not liable for indirect, consequential, or special losses, including but not limited to travel disruption, loss of enjoyment, or loss of income.

10. Indemnification

You agree to indemnify ooceandi against any claims, losses, or expenses arising from your breach of these Terms, your failure to comply with on-board safety instructions, or your negligent or unlawful conduct during a Tour.

11. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from these Terms or a Tour booking shall be subject to the exclusive jurisdiction of the courts of Johor Bahru, Johor, Malaysia. We encourage informal resolution in the first instance — please contact us directly before initiating formal proceedings.

12. Changes to These Terms

We may update these Terms periodically. Updated Terms are effective from the date shown at the top of this page. Bookings made before an update are subject to the Terms in force at the time of booking confirmation.
